Promoter Kristoffer Krohn of Green United has been accused of participating in a $18 million Cryptocurrency Mining fraud scheme. He is currently appealing his case, arguing that the U.S. Securities and Exchange Commission (SEC) should be compelled to dismiss the lawsuit as their allegations of him selling securities are incorrect. On October 24th, Kristoffer Krohn stated to the Utah federal court that the Tenth Circuit Court of Appeals should decide whether buyers of the company's equipment are considered to have joined a 'common enterprise', which the SEC used as the basis for accusing the company of selling investment contracts under securities laws. Krohn wrote in his appeal, 'The U.S. Securities and Exchange Commission has not and cannot accuse Green Box purchasers of having any rights or interests in Green United's business operations or profits.' If the appeal is successful, Krohn will be allowed to defend his case before a three-judge panel, a process that may take several months before a final decision is made. In September, Green United failed to dismiss the $18 million encryption Mining fraud lawsuit filed by the SEC.
